1 范围

本标准规定了租船合同中使用的与装卸时间相关的术语及其定义,包括一般术语、船舶抵达时、装

卸时间的表示、装卸时间的起算、装卸时间的计算、滞期费和速遣费等。

本标准适用于租船合同中装卸时间的计算和商务处理。

2 一般术语

2.1

租船合同 charter party

船舶出租人与承租人达成的协议,规定承租人以一定的条件向船舶出租人租用一定的船舶或一定
的舱位以运输货物,并就双方的权利和义务、责任与豁免等各项以条款形式加以规定,用以明确双方的

经济、法律关系。

注:
租船合同包括任何形式的运输合同或包运合同,包括以提单为证明的合同,参见附录
A。

2.2

港口 port

船舶装货或者卸货的任何区域,包括但不限于泊位、码头、锚地、浮筒和近海设施;同样也包括船舶

被指令等待依次进港的区域,即使该区域位于港口的法律、税收或行政管辖区域之外。

2.3

berth

船舶准备装货或卸货的特定区域,包括但不限于码头、锚地、近海设施或其他以装卸货为目的的

地点。

2.4

装卸时间 laytime

合同双方当事人约定的一段时间,在此期间出租人应使船舶处于可适于装/卸货作业且无需支付运

费之外的附加费用。

2.5

装卸率 rate of loading/discharging

按合同约定,每个连续日,或工作日,或晴天工作日装卸的货物数量。

2.6

装卸准备就绪通知书 notice of readiness;NOR

按租船合同的要求,向承租人、发货人、收货人或其他人递交的关于船舶已经到达港口或泊位(视情

况而定)并已准备就绪进行装货或卸货的通知书。

3 船舶抵达时

3.1

到达后即可抵靠 reachable on arrival

承租人保证当船舶抵达港口时,将提供无需耽搁即可直接安全驶入靠泊的并可供其装/卸货作业的

泊位。

3.2

始终可以进入 always accessible

承租人保证当船舶抵达港口时,将提供无需耽搁即可直接安全驶入靠泊的并可供其装/卸货作业的
泊位。承租人还保证船舶在装货或卸货之前、之中或者完成之后的任何时间都能安全无需耽搁地离开

泊位。

3.3

船舶通过检疫 vessel being in free pratique

船舶符合港口的卫生要求。

4 装卸时间的表示

4.1

day(s)

连续24小时的期间,不足一 日的时间按比例计算。

4.2

日历日 calendar days

从00:00时到24:00时止的连续24小时的期间。不足一
日历日的时间按比例计算。

4.3

约定日 conventional days

从任一确定的时间开始起算的连续24小时的期间。不足一约定日的时间按比例计算。

4.4

工作日 working days

根据当地法律和习惯,通常工作进行之日。

4.5

连续日 running days;consecutive days

一 日紧接着另一 日的日数。

4.6

连续时 running hours;consecutive hours

一个小时紧接着另一个小时的小时数。

4.7

节假日 holiday

每周正常休息日以外的日或其中的一部分,按照当地法律和习惯,在此本属于正常工作时间内的工

作通常不予进行。

4.8

晴天工作日 weather working days

一个工作日或工作日的一部分,在此期间船舶可以,或如船舶仍在等待靠泊中可能可以,在不受天
气的影响下进行装卸货物作业。如果受天气影响导致作业中断,或者装卸货作业已经进行而受天气影

响导致作业中断,则装卸时间应参照中断持续时间与不受天气影响下正常工作时间之比例进行扣减。

4.9

连续24小时晴天工作日 weather working day of 24
consecutive hours

一个连续24小时的工作日或工作日的一部分,在此期间船舶可以,或如船舶仍在等待靠泊中可能

可以,在不受天气的影响下进行装卸货物作业。如果受天气影响导致作业中断,或者装卸货作业已经进

行而受天气影响导致作业中断,则中断的时间要从装卸时间中扣除。

4.10

24小时晴天工作日 weather working day of 24
hours

由一个或多个工作日的工作时间加起来构成的24小时,在此期间船舶可以,或如船舶仍在等待靠
泊中可能可以,在不受天气的影响下进行装卸货物作业。如果受天气影响导致作业中断,或者装卸货作

业已经进行而受天气影响导致作业中断,则实际中断的时间要从装卸时间中扣除。

4.11

(工作日)天气许可 (working day)weather permitting

与连续24小时晴天工作日定义相同。

5 装卸时间起算

5.1

等泊损失的时间计为装货或卸货时间或装卸时间 time lost
waiting for berth to count as loading
or

discharging time or as laytime

如果没有空闲的装货或卸货泊位而船舶无法在等候的地点递交准备就绪通知书时,船舶损失的时
间如同装卸时间已经起算一样计为装卸时间,如果装卸时间已经届满,则计为滞期时间。此时间一直计

算到有了泊位为止。

当船舶抵达能够递交准备就绪通知书的地点时,装卸时间或滞期时间应在递交该通知书后继续计

算,但就装卸时间而言,则在租船合同规定的通知时间届满之时继续计算。

5.2

无论在泊与否或有无泊位 whether in berth or
not(WIBON)or berth or no berth

船舶抵达后指定的装货或卸货泊位没有空闲时,船舶抵达港口的任何通常等候地点即有权递交准

备就绪通知书,装卸时间应按租船合同规定开始起算。

5.3

无论在港与否 whether in port or not;WIPON

如果船舶抵达后指定的装货或卸货泊位以及港口的通常等候地点都没有空闲时,船舶有权在港口

之外的任何认可的等候地点递交准备就绪通知书,装卸时间应按租船合同规定开始起算。

5.4

除非提前开始 unless sooner commenced

当准备就绪通知书已经递交之后而合同约定的装卸时间尚未起算之前,但装货或卸货作业已经进

行的情况下,装卸时间开始起算。

5.5

除非提前开始,实际使用时间应当计入 unless sooner
commenced,in which case actual time used

准备就绪通知书已经递交之后而合同约定的装卸时间尚未起算这段时间内实际使用的时间应当计

为装卸时间。

5.6

使 unless used

装卸时间已经开始起算,但装货或卸货作业在除外的时间内进行,则此段实际使用时间应计为装卸

时间。

6 装卸时间的计算

6.1

每日每舱口(时间计算) per hatch per day(laytime calculation)

装卸时间的计算是用货物数量,除以每天每舱口约定装卸率乘以船舶舱口数的乘积,即装卸时间=

货物数量/(日装卸率×舱口数)。

每对平行的双层舱口按一个舱口计算,但可由两个工班同时进行作业的舱口则按两个舱口计算。

每日每舱口装卸时间计算方法见式(1):

装卸时间的计算是用最大货舱载货量,除以每天每工作舱口或每可工作舱口约定装卸率乘以该货

舱服务的舱口数的乘积,即装卸时间=最大货舱载货量/(每舱口日装卸率×该货舱服务的舱口数)。

每对平行的双层舱口按一个舱口计算,但可由两个工班同时进行作业的,则按两个舱口计算。每日

6.3

装卸时间均分计算 to average laytime

分别计算装货时间和卸货时间,用一个作业中节省的时间抵消另一作业中超用的时间。

6.4

装卸时间合并计算 reversible laytime

承租人有权选择将约定的装货时间和卸货时间加在一起计算。行使了选择权的结果,就如同约定

了一个装卸作业的总时间。

6.5

除外或扣除 excepted or excluded

在某些特定时间内进行装货或卸货,该特定时间也不计算为装卸时间。

7 滞期费和速遣费

7.1

滞 期 费 demurrage

因不是出租人的责任所造成的超过装卸时间的船舶迟延而需要支付给出租人的约定费用。除非租

船合同另有约定,否则装卸时间的除外规定不适用于滞期费。

7.2

速遣费 despatch money;despatch

船舶在装卸时间届满前完成了装货或卸货,出租人需要支付的约定费用。

7.3

按节省的全部工作时间计算速遣费 despatch on all
working time saved;WTS

按节省的全部装卸时间计算速遣费 despatch on all
laytime saved

对从装货或者卸货完毕之时起至装卸时间届满之时止扣除装卸时间除外的时间后的这一段时间所

支付的速遣费。

7.4

按节省的全部时间计算速遣费 despatch on all time
saved;ATS

对从装货或卸货完毕之时起至装卸时间届满之时止包括装卸时间除外的时间在内的这一段时间所

支付的速遣费。
